This is particularly relevant to me as my wife just got a ticket in Illinois.  She had headphones in, but was not listening to anything.  She had taken a call while walking to the car and then hung up before getting in the car.  She forgot her earbuds were in.

This has nothing to do with safety, otherwise, deaf people would should not be allowed to drive.
