This law is destined to fail. There are already laws in affect that determine how much premium money is supposed t be held for claim payments. The money ofver and above that is invested in order to keep premiums down. 

All the money invested helps keep the economy going. This action in essence is absolute proof the end game is to install a single payer system. The result will be the end of health insurance companies, massive layoffs, more people on welfare and food stamps, and higher inflation. Welcome to post WWI Germany.

This isn't something the national media report since there's no "racism" that can be exploited. Black on black, or black on white crime is the norm. Also, they overlook these deaths "if" the black person was killed in the commission of a crime. 

The fact is the crime rate among blacks is high, the unemployment rate among young black men is high, and their anointed one has done nothing to encourage business to expand and hire these people. He and the DNC is more interested in bringing on more illegals, granting them amnesty, and making sure they vote Democrat, so they can stay in  power.

This is what the Court said:

the Court ruled 7–2 that a right to privacy under the due process clause of the 14th Amendment extended to a woman's decision to have an abortion, but that right must be balanced against the state's two legitimate interests in regulating abortions: protecting prenatal life and protecting women's health. Arguing that these state interests became stronger over the course of a pregnancy, the Court resolved this balancing test by tying state regulation of abortion to the trimester of pregnancy.

It's the "right to privacy", not the right to have an abortion. Even then the court put the state's interests in the decision.  Furthermore:

The Court later rejected Roe's trimester framework, while affirming Roe's central holding that a person has a right to abortion until viability.The Roe decision defined "viable" as being "potentially able to live outside the mother's womb, albeit with artificial aid", adding that viability "is usually placed at about seven months (28 weeks) but may occur earlier, even at 24 weeks."

 @Evermyrtle  @GrizzMann  @icis Sadly in many cases that's true. It would be far better to have them in a Hospice where comfort is given if there indeed, is no hope of recovery.

Hospice is paid for by Medicare so there's no excuse "not" to access the system if the need arises. The strange thing is in some cases, a person may start to thrive and not need Hospice since the care given leads to an overall well being of the individual.

Too often though, nursing homes that have contracts with a Hospice provider either don't understand, or are unwilling, to relinquish care to the provider. It comes down to the individuals in the homes, especially the ED, the Social Worker, and the Director of Nursing.

If you examine the political spectrum of these people, I'd guarantee they're predominantly Liberal or lean that way. Many have the opinion these people should be "taken care of" and really don't look at them as individuals at all.

 @GrizzMann  @icis From the news reports we had last night, that was understood to be the case of a DNR. The family also stated that she had opted for this facility due to the fact they "wouldn't" attempt to revive her. I can't speak for the family, but in any case, there hasn't been a move toward prosecution.

I for one would like to see the documentation that she signed when she was admitted to this facility. There are different laws for every state and this would have to comply with the laws in California.

This is a very slippery slope. Having been involved with people who actually have a mental illness, it seems this could be taken far out of the realm of the medical profession and put into the hands of the bureaucracy. I think all advocates for the mentally ill should be very wary of something like this happening.

The way that some perceive the defense of the Constitution and particularly, the Bill of Rights, as somehow being a mental defect, and totally anti-social, scares the hell out of me. III. Emergency Confinement

A police officer is also authorized to take into custody any person whom the officer reasonably believes meets the criteria for commitment. The officer may take him to a general hospital for emergency examination. He must be examined within 24 hours and released within 72 hours, unless detained and committed on an emergency basis under §17a-502 (CGS §17a-503(a)).

The federal department of education was instrumental in pursuing mainlining kids. They should jump on this with both feet. We do have a problem though. This administration is so afraid of disturbing the unions. There would be advocacy groups compounding the problem swearing mainlining works. We also have all these schools with a zero tolerance policy that only serves to create more problems.

Seeing as how the parents, from my understanding, were not notified of the problem and advised to be there or send a representative, we have a direct violation of the 4th, 5th, and 6th, Amendments. I would also say we have a violation of the 8th since this kids is living in a nightmare now. I wonder if any attorney will have the balls to pursue this case pro bono.

All that without even thinking about ignoring school policies.

Find "healthcare" or "safety net" anywhere in the Constitution. If you demand healthcare from the government, you don't deserve a voice in how it's delivered. Only a free market can deliver a method of care that is beneficial to all.

The idea that the government can deliver on promises that they can provide a comprehensive system cheaply, and efficiently, with a level of care that would benefit all is not only sophomoric, but outright fallacious.  every program the government has initiated has cost far more than the designers were willing to admit.

 @PghVince It doesn't have to be a legal battle. It comes from concerned and involved parents who want to understand and direct their offspring on the right path. Remember, the teachers work for you, the parent. If a parent doesn't think something is right in the system, they can approach the teacher one on one in the parent teacher conferences. But then I've seen many parents who are too lazy or ignorant to even attend. This is inexcusable. Children are a gift, and as such, should be directed on the right path. I don't see much of that happening in many cities. It happens more often in the "burbs and rural areas. Is it a wonder the "red" states are primarily agrarian in nature?

i don't think it's as much the schools as it is the laziness of parents to find out what their kids are being taught and steering them on the right course.

The bad thing about teacher's unions is the mediocre are rewarded equally with the competent. What incentive is there for teachers to excel, other than their own integrity?

Then you have parents who sit in front of the TV more interested in the life of Zoey Kardashian than of their own flesh and blood.

In some cases these are single parents who try to do what they can for their kids, but fall far short because they're out scraping for every dollar they can to pay the rent. These are the people who would l0ve to spend some quality time with their kids but sometimes life interferes.

As far as the Liberal in question, I'd bet she was more interested in the sales at the mall, whether she could get her nails done while there and at the same time recording her soap. But as they say, you can't fix stupid...........or laziness.

 @daves  @Racefish No one "said it", the ones who were for it weren't saying anything and the masses buying into it weren't smart enough to ask the right questions. It was sold the same as the "Obamaphone". You still end up paying for it but the stupid people think it's coming from the government and not out of the neighbor's pocket.

As far as "everyone chipping in", why are the Congress, President, and Supreme Court not covered??? This in fact is elitism to the max. It's the same old "do as I say, not as I do" mantra. The problem this time is the taxpayers are getting screwed, the patient is getting screwed, and the idiots that wrote this monstrosity are patting themselves on the back for doing a good job and not having to worry about complying with the law themselves.

Really? Has anyone really taken the time to see "IF" the prescription they are taking now is even covered???

I have a friend who is on an arthritis drug that will not be covered. He knows this because he's already been informed by his doctor and the pharmacy. The thing is sometimes the medications that are covered will not work due to a person's physiology. My son is also on a medication that isn't covered now unless his MD specifically writes to the state and "requires" he be covered.

Too bad some of the people that thought this was such a good idea are going to be left hanging. But then, life is a learning experience and ignorance is expensive.

 @mudguy Some have already started the process of getting out of it. On top of that, some doctors are slowly trimming their practice.

 

Physicians are looking for a way out. They are becoming businessman, social media entrepreneurs and commentators, writers, reformers, and career coaches. They are retiring early and cutting their hours. I spend less time in the clinic than ever before. Each year I replace some of my office time with non clinical revenue generating activities. The joy of patient care is being overshadowed by regulation. We are quietly and incrementally bowing out...

Pre-existing has already kicked in. The huge taxes as well as the personal mandate haven't. Liberals are going to find their health care is even worse since the system will be glutted with those who have never bothered to look after their own welfare, and those who have no personal MD.

I hope people are happy with this since I'm not going to tolerate one Liberal whining about the system. They wanted it, they got it.

By the way, the Bush era tax reductions are going to expire 1/1/2013. That will be another mill stone around the necks of the middle class wage earners.

 @MikeMaharrey-TenthAmendment  @Racefish They only ruled on the ability of Congress to "tax".  That was the gist of it. Roberts made it clear the law couldn't be enacted under the Commerce Clause.

Very true. The Supreme Court did "not" rule on the Constitutionality of the law itself. It only ruled on the federal government's authority to levy the "tax" which the Administration still insists is a "penalty".
