We don't live in a Theocracy, Shane. Even you couldn't apply this law strictly in a biblical way. God's judgement on heretics is already here-they are self-condemned-unless they repent. The church has it's own prescriptions for dealing with heretics, and it's not to execute civil law - or Mosaic law-to punish them. This is what happens though when we don't rightly distinguish between God's people and his economy. Nobody can keep or apply Mosaic law then or now. Not going to happen. When Jesus' government is takes over all the world, then Theocracy will reign over the nations. For now, God allows the world a measure of power to run it's affairs according to conscience and general revelation.
