@AnthonyPaulPriley But capitalism and society don't determine an items value by how much time, effort or resources it takes to create such item. Those are opportunity costs that matter not at all to whether the market deems the product of sufficient value to be economically successful.
Perhaps all this patent and copyright reform talk is one indicator that the costs (including litigation) of patent and copyright creation & enforcement can not much longer sustain traditional market economics?

Unfortunately, what's absurd is the concept that ideas, by themselves, can be patented without having to show how the idea is put into practice in a specific incarnation. This is the bar that fails us.
If I have an idea to "go to the moon" and patented it, then any other method of "getting to the moon" would be covered. This is a ludicrous state of affairs that springs from having examiners that are so overworked that spotting patents that should be tossed for being obvious, or because there's tons of prior art are being passed through all the time. (See "thermal refreshing of bread" anyone?).
IMHO patents and IP should not be idea or concept based, but execution-specific based. Statistically it's now impossible for there *not* to be more than one person with the same idea on our planet.
