Horse shit. Kodak invented the digital camera! Suggest you read some of the actual history about Kodak and digital before you conjecture like that. It makes an excellent case study in how an incumbent not only knew a new disruptive technology was coming, but actively developed it, yet inevitably failed.

Thinking about this.. how is this supposed to work? Most shareholder's agreements have a rofr (right of first refusal agreement)... so how on earth is the fund going to get benefit from the shares? Is there information leakage back to the fund? If so there's surely a confidentiality breach.

This is extremely dodgy. It's substantially worse than Yahoo's CEO fudging his major which is today's front page news. I'm sure if I had a chance to think about this there would be some breach of fiduciary duty or violations of some securities law around misleading and deceptive conduct.
