As long as the regulation exist, you owe the taxes.  Tax laws change every year, but that doesn't mean you don't owe the taxes or can take new deductions in previous years based on future tax law.  At the end of the day, there are plenty of hotels posting rooms on Airbnb and consumers renting a room both of which will need to pay applicable state and federal taxes on that income.
